Introduction
This Custom Development Policy ("Policy") outlines the terms for custom web and application development services provided by Web Temple ("We," "Us," "Our") to our customers ("You," "Your"). By engaging us for custom development, you agree to the terms in this Policy.
Scope of Services
Design and development of websites, applications, or specific features as per the agreed specifications.
Includes initial consultation, project planning, development, and testing phases.
Ongoing maintenance and support after project delivery (covered under separate agreements).
Training on the use of developed solutions unless explicitly included in the project scope.
Third-party integrations or APIs not explicitly agreed upon in the project specifications.
Any changes to the agreed-upon scope of work must be documented and approved through a Change Request, which may result in additional fees or revised timelines.
Project Deliverables
Defined deliverables will be outlined in the Statement of Work (SOW) or project agreement.
Deliverables will be provided in the agreed format and according to the agreed schedule.
Comprehensive testing will be conducted before delivering the final product to ensure functionality and compliance with agreed specifications.
Minor revisions are included within the agreed scope of work.
Additional revisions beyond the agreed scope will incur additional charges.
Customer Responsibilities
Provide detailed project requirements, including functionality, design preferences, and any third-party tools to be integrated.
Provide feedback and approvals promptly to ensure project timelines are met.
Supply all necessary content, branding materials, and assets required for development.
Payment Terms
A payment schedule will be outlined in the project agreement, typically divided into:
Initial deposit (e.g., 50% of the total cost) upon agreement signing.
Milestone-based payments (if applicable).
Final payment upon project completion.
Initial deposits are non-refundable unless the project is canceled by us before work begins.
Late payments may result in project delays or suspension of work until outstanding payments are cleared.
Intellectual Property
You retain ownership of the final deliverables upon full payment.
We retain ownership of any pre-existing materials, code libraries, frameworks, templates, or tools developed or owned by us prior to the start of the project. These materials are integrated into the deliverables as part of the development process.
We grant you a non-exclusive, royalty-free license to use the pre-existing materials incorporated into the deliverables solely for the purpose of operating and maintaining the final product. This license does not grant ownership or rights to modify, distribute, or resell the pre-existing materials outside of the agreed scope of the deliverables.
We reserve the right to showcase the completed project in our portfolio unless otherwise agreed upon in writing.
Warranties and Support
We offer a 30-day warranty period for bug fixes and issues directly related to the agreed-upon scope of work.
Support and maintenance beyond the warranty period are subject to separate agreements and fees.
Termination
You may terminate the project with 30 days’ written notice. Payments for work completed up to the termination date are non-refundable.
We may terminate the project for non-payment or breach of terms with 7 days’ notice.
Amendments
This Policy may be updated to reflect changes in our services or operational practices. Customers are advised to review this Policy on our website periodically to stay informed of any changes.
While not obligated, we may provide notifications of significant updates as a gesture of goodwill.
