Introduction
This Service Cancellation and Termination Policy ("Policy") outlines the terms for canceling or terminating services provided by Web Temple ("We," "Us," "Our") to our customers ("You," "Your"). By using our services, you agree to the terms in this Policy.

  1. Scope

    1. Covered Services, including but not limited to:
      • Hosting services

      • Managed services

      • Custom development projects

      • Larvee application products

      • Any future services or solutions introduced by Web Temple

    2. Exclusions:
      • Third-party services directly contracted by you, even if integrated with our services.

  2. Cancellation by Customer

    1. Notice Period:
      • You may cancel services by providing at least 30 days’ written notice prior to the end of the current billing cycle.

    2. Refunds:
      • Refunds for prepaid services will only be issued on a pro-rata basis for unused periods if explicitly specified or included in the agreements, excluding non-refundable fees (e.g., setup fees, domain registrations).

    3. Data Retention:
      • Data related to canceled services will be retained for 30 days post-cancellation. After this period, data will be permanently deleted.

  3. Termination by Web Temple

    1. Reasons for Termination:
      • Non-payment of invoices after 7 days from the due date.

      • Breach of our Terms of Service, Acceptable Use Policy, or other relevant agreements.

      • Legal or regulatory requirements necessitating termination.

    2. Notice Period:
      • We will provide 7 days’ notice before terminating services unless immediate termination is required (e.g., for illegal activities, serious violations of our policies, or other actions that pose a risk to our infrastructure, services, or other customers).

    3. Post-Termination Data Access:
      • Customers may request access to their data within 30 days of termination. Data access may be subject to additional fees.

  4. Effects of Cancellation or Termination

    1. Service Discontinuation:
      • Upon cancellation or termination, all access to the affected services will be disabled.

    2. Outstanding Payments:
      • You are required to settle all outstanding invoices, including fees for services rendered up to the termination date. Managed or hosted services, or those involving infrastructure tied to our offerings, will remain unavailable until all payments are cleared. Additionally, we reserve the right to take legal action to recover any outstanding payments, and all legal fees incurred will be the responsibility of the customer.

    3. Account Closure:
      • Once all payments are settled, the account will be formally closed, and related data deleted as outlined in Section 2.3.

  5. Early Termination Fees

    1. Contractual Commitments:
      • For services under fixed-term agreements, early termination may incur fees equivalent to the remaining contract value.

      • Refunds for prepaid services will only be issued on a pro-rata basis for unused periods if explicitly specified or included in the agreements, excluding non-refundable fees (e.g., setup fees, domain registrations).

    2. Waivers:
      • Early termination fees may be waived under specific circumstances, such as service outages exceeding SLA guarantees.

  6. Amendments

    1. Policy Updates:
      • This Policy may be updated at our sole discretion to reflect changes in our cancellation and termination processes. Customers are advised to review this Policy on our website periodically to stay informed of any updates.

      • While not obligated, we may provide notifications of significant updates as a gesture of goodwill. However, missed notifications will not excuse non-compliance with the updated Policy.
