Introduction
Welcome to Web Temple! These General Terms of Service ("Terms") govern your use of our services, including but not limited to hosting, web development, app development, managed services, and Larvee application products, standard or custom version (collectively referred to as "Services"). By using our Services, you agree to these Terms. If you do not agree, you may not use our Services.

  1. Definitions

    1. "We," "Us," and "Our" refer to Web Temple Sdn Bhd, WebTemple Pte Ltd, and their subsidiaries.

    2. "You" and "Your" refer to the customer or user of our Services.

    3. "Services" include all offerings by Web Temple, such as hosting, development, and Larvee application products.

    4. "Agreement" refers to these Terms, along with any related policies or service-specific agreements.

  2. Scope of Services

    1. We provide hosting, domain registration and renewal, website design, web/app development, managed services, website editorial and technical maintenance, web application updates and upgrades, and related solutions.

    2. Additional terms may apply to specific services (e.g., Managed Services Agreement, Acceptable Use Policy).

    3. Service descriptions and limitations are detailed in respective agreements or Service Level Agreements (SLAs).

  3. Responsibilities

    1. Ensure compliance with all applicable laws and regulations.

    2. Maintain the security of your login credentials and accounts.

    3. Provide accurate and up-to-date information for billing and communications.

    4. Ensure that your use of the Services does not infringe on the rights of others or violate our Acceptable Use Policy.

  4. Prohibited Activities

    1. You may not use our Services for:

      • Illegal activities or content

      • Spamming, phishing, or malicious software

      • Hosting content that infringes intellectual property rights

    2. Detailed restrictions are outlined in our Acceptable Use Policy.

  5. Fees and Payment

    1. Service fees are detailed in our Pricing, Billing & Payment Policy.

    2. Payments must be made by the due date to avoid service interruptions.

    3. Non-refundable services include, but are not limited to, domain registrations or renewals, SSL certificate purchases or renewals, one-time customizations, website design, website editorial and technical maintenance, web application updates or upgrades, and third-party provider subscriptions where applicable.

    4. Late payments may result in account suspension or termination.

  6. Data Privacy

    1. We adhere to our Privacy Policy, which governs the collection, use, and storage of your data.

    2. You are responsible for obtaining consent from your users when sharing their data with us through our Services.

    3. For GDPR, PDPA, or similar compliance, specific Data Processing Agreements may apply.

  7. Service Availability and SLAs

    1. Hosting uptime and support response times are governed by our Service Level Agreement (SLA).

    2. Scheduled maintenance will be communicated in advance.

    3. We are not liable for downtime caused by:

      • Force majeure events

      • Your actions or failure to act

      • Third-party issues (e.g., ISPs, payment gateways)

  8. Intellectual Property

    1. All custom development, Larvee applications, and related materials provided by us remain our intellectual property unless explicitly transferred in writing.

    2. You retain ownership of content uploaded to your website or app, but you grant us a license to use it for delivering Services.

  9. Termination

    1. You may terminate services by providing 30 days written notice.

    2. We may terminate services for:

      • Non-payment
      • Breach of these Terms
      • Legal or regulatory requirements
    3. Upon termination, you must settle outstanding fees, and we will retain your data and data backups for up to 30 days.

  10. Limitation of Liability

    1. We are not liable for indirect, incidental, or consequential damages.

    2. Our liability is limited to the amount paid by you for the affected service within the past six (6) months from the date the issue arises. We are not liable for any claims arising after the service is terminated or for issues discovered after termination unless explicitly agreed upon in writing.

  11. Amendments

    1. We may amend these Terms at our sole discretion. Customers are advised to frequently review the Terms on our website to stay informed of any updates. While not obligated, we may provide notifications to inform customers of significant updates as a gesture of goodwill.

    2. Continued use of Services after amendments signifies your acceptance.

  12. Governing Law

    1. These Terms are governed exclusively by the laws of Malaysia.

    2. Disputes are subject to the exclusive jurisdiction of the courts in Kuala Lumpur, Malaysia.
